I'm keeping an open mind until I see a side profile of Michael Byrd's forehead. Why would Merrick Garfinkle (his real name) conduct an eight month internal investigation and then name Michael Byrd as the shooter and say that they had found him not guilty? Look at how the light shines off of their foreheads in much the same way. Looks like a match to me.
Update 3/28/2023: I found a side profile image of Michael Byrd in this "confession" video with Lester Holt, and it clearly doesn't match the shooter in my opinion. The forehead shape doesn't match, and neither do the skin tone and hair color.
