I'm keeping an open mind until I see a side profile of Michael Byrd's forehead. Why would Merrick Garfinkle (his real name) conduct an eight month internal investigation and then name Michael Byrd as the shooter and say that they had found him not guilty? Look at how they both appear to have the same creases in their foreheads. Looks like a match to me.
Update 3/28/2023: I found a side profile image of Michael Byrd in this "confession" video with Lester Holt, and it clearly doesn't match the shooter in my opinion. The forehead shape doesn't match, and neither do the skin tone and hair color. There are no creases in Byrd's forehead either. It's smooth.
Update 2/6/25:
I found this video tour of the Speaker's Lobby, and the circular decorations that align with the top of the shooter's head in the screenshot appear to match someone who is 5'9" like Chuck Schumer, and not someone who is 6'2" like Michael Byrd. The center of the circles appear to be six feet off the floor, and are centered vertically to be aesthetically pleasing. The man standing next to one in the video tour appears to be about 5'9" like Chuck Schumer, and is standing next to someone who is clearly a short man. The two men in the center of the photo are tall, probably about 6'2", like the height of Michael Byrd. This will tell the story of who the shooter is in my opinion, if the screenshot of the shooter doesn't already, but I think it does. Also, according to this People article, Schumer was terrified that day because he thought that the angry mob was after him. He also admits to being within 20 feet of the people who stormed the Capitol.
